As those who are active in the Proposition 65 settlement negotiations are aware, in court Consent Judgment settlements, required if the Private Party Enforcer has filed suit, are nearly always far more expensive then out of court settlements. Last year, as we showed, there were 436 Out of Court settlements, averaging a total cost to the companies in question of $21,380 per settlement.
In 2020, there were fewer in court Consent Judgment settlements. There were 179, with an average total cost of $56,236.00 each (penalties, attorneys' fees and additional payments. With respect to the out of court settlements, the fees agreed to comprised 83.32%. For the consent judgment settlements, excluding the one settlement by the California Attorney General's office (which does not include attorneys' fees), the fees were 62.35%
