CBL is sometimes asked what chemicals are most commonly the subjects of Proposition 65 listings and litigation. We've ususally answered the question impressionistically, But we thought it would be worthwhile to do an actual head count. So we took a look at the notices served from July 1, 2013 through June 30, 2014. There were 1045 notices during this time frame. Many were directed to just one or two companies. But many were directed to five or ten or more companies. However, this chart shows where the focus is: DEHP, lead, Cocamide and TDCPP.
From what CBL has seen, the cocamide and TDCPP notices are generally directed to many companies, so Proposition 65 claims involving these chemicals are every bit as big, if not bigger than, DEHP and lead.
I wonder if they'll go after apple growers soon.
