For many months, CBL has been following the progress of Medicare's attempts to more aggressively recover benefits paid from tort settlements. This isn't a California issue, but it's a really important one for every company and every lawyer involved in tort litigation anywhere in the US. The Center for Medicare and Medicaid Services ("CMS") has just announced that it will not require the exchange of file data until January 1, 2011. We assume that the test exchanges aren't going as well as expected. As with previous continuances, however, this does not affect the obligations of all personal injujry litigants in cases involving Medicare recipient plaintiffs to protect Medicare's recovery rights.
