CBL first declared Ford's hopes for reversal of the Buell-Wilson punitive damage award (as reduced in multiple post-verdict proceedings) dead in a post on March 28, 2008. Wrong. Ford soldiered on for nearly another two years.
But it's over now. The US Supreme Court says ixnay on ertsay. The compensatory damages ($30M+) have already been paid. The $55 million punitive judgment is up to $87 million including interest, says plaintiff's counsel. And it looks like there's nothing left but to pay it.
The one thing that came out of Ford's appeals over the last two years? A very plaintiff friendly Court of Appeal decision got wiped off the books when the Cal Supremes granted review -- a grant they later dismissed.
