CalBizLit reported here in 2007 on the first verdict in the DBCP cases brought by Nicaraguan banana workers against Dole Foods, and "California Punitive Damages an
Exemplary Blog" (to whom a hat tip goes for this update) later reported on the punitive damage award. The trial judge eventually granted in part Doles' motion for judgment notwithstanding the verdict as to the punitive damages.
Now the same judge is taking a close look at some of the many other cases, ordering a hearing on whether two cases involving dozens of workers should be dismissed for fraud. Little thing about plaintiffs who (a) never worked on a banana farm and/or (b) had children even though they claimed sterility:
