That's a two-edged sword. Civil Code sec. 1717 and the cases interpreting it would almost certainly make this fee shifting provision reciprocal. Thus, if the arb agreement is shaky, and the plaintiff beats the petition or motion to compel, they should recover interim fees against the company.
